Монгол хувилбар
Энэхүү Үйлчилгээний нөхцөл (цаашид «Нөхцөл» гэх) нь AdCreator үйлчилгээг ашиглахтай холбоотой Таны болон бидний эрх, үүргийг тодорхойлно. Үйлчилгээг ашиглахаасаа өмнө Нөхцөлтэй бүрэн танилцана уу.
1. Талууд, Нөхцөлийг хүлээн зөвшөөрөх
AdCreator үйлчилгээг (ad-creators.mn, цаашид «Үйлчилгээ» гэх) Лумо промо ХХК (цаашид «бид» гэх) үзүүлнэ. Компанийн хаяг, регистрийн дугаарыг энэ хуудасны төгсгөлд заасан.
Нөхцөл нь бид болон Үйлчилгээг ашиглаж буй Таны хооронд байгуулагдах гэрээ бөгөөд Иргэний хуульд заасан гэрээний стандарт нөхцөл юм.
Та нэвтрэхээсээ өмнө 18 нас хүрсэн бөгөөд Нөхцөлийг хүлээн зөвшөөрч байгаагаа урьдчилан тэмдэглээгүй нүдийг өөрөө тэмдэглэж баталгаажуулна. Бид Таны Facebook-ээр баталгаажсан бүртгэл, Таны хүлээн зөвшөөрсөн хувилбар, огноог бүртгэнэ. Нөхцөл ad-creators.mn/terms хаягт байнга байрлах бөгөөд AdCreator-ын хуудсуудын доод хэсгээс холбогдоно.
Нөхцөл монгол, англи хэлээр гарсан. Хоёр хувилбарын хооронд зөрүү гарвал монгол хэл дээрх эх давамгайлна.
2. Нэр томьёо
Нөхцөлд хэрэглэсэн дараах нэр томьёог доор заасан утгаар ойлгоно:
- «Үйлчилгээ» гэж ad-creators.mn вэбсайт болон түүн дээрх AdCreator аппликейшныг;
- «Захиалга» гэж видео зар бүтээлгэх Таны хүсэлтийг;
- «Видео зар» гэж Таны зургаас хиймэл оюун ухаан (AI) бүтээж, Таны оруулсан мэдээллийг бичвэр болгон нэмсэн видеог;
- «Буст» гэж Видео зарыг Таны өөрийн Facebook хуудас, зарын бүртгэлээр Facebook, Instagram-д төлбөртэй зар болгон гаргахыг;
- «Meta» гэж Facebook, Instagram-ыг эрхлэн явуулдаг Meta Platforms компанийг;
- «Премиум» гэж тодорхой хугацаанд видеог удаан хадгалуулах төлбөртэй эрхийг;
- «Өөрийн санаагаар бүтээсэн видео» гэж манай видеоны загвар ашиглахгүйгээр, Таны өөрийн бичсэн санаанаас AI бүтээсэн Видео зарыг;
- «Цэвэр видео» гэж дээр нь текст бичээгүй видеог;
- «Хадгалсан загвар» гэж дахин ашиглахаар хадгалсан Өөрийн санаагаар бүтээсэн видеог. Үүнд Таны бичсэн санаа, зураг авалтын төлөвлөгөө (AI видеог бүтээсэн заавар, prompt), урт, чанар, текстийн зохион байгуулалт (видеон дээрх текстийн байрлал, хэмжээ, өнгө, фонт, харагдах хугацаа, эффект), мөн Цэвэр видеоны хуулбар хадгалагдах бөгөөд энэ хуулбарыг «жишээ» гэнэ;
- «Хуваалцсан загвар» гэж бусад худалдагчид харуулахыг Таны хүссэн, бидний зөвшөөрсөн Хадгалсан загварыг;
- «Албан ёсны загвар» гэж бидний бүтээж, бүх худалдагчид санал болгодог видеоны загварыг, түүний дотор Хуваалцсан загвараас бидний бүтээсэн загварыг;
- «Үнэгүй видео» гэж найзаа урьсны төлөө 15-р хэсэгт заасны дагуу олгодог, нэг видеог үнэ төлбөргүй хийлгэх эрхийг.
3. Үйлчилгээг ашиглах эрх
- Үйлчилгээг зөвхөн 18 ба түүнээс дээш насны, бүрэн эрх зүйн чадамжтай хүн ашиглана.
- Та өөрийн Facebook бүртгэлээр нэвтэрч, Монголын утасны дугаараа оруулна.
- Та үнэн зөв мэдээлэл өгч, бүртгэлээ бусдад ашиглуулахгүй.
- Үйлчилгээг машин, үл хөдлөх хөрөнгийн худалдаа, зуучлал зэрэг бизнесийн зорилгоор ашиглавал Нөхцөл Танд болон Таны бизнест адил хамаарна.
4. Үйлчилгээ
- Та машин эсвэл үл хөдлөх хөрөнгийн зураг оруулж (видеоны уртаас хамаарч 3–30), загвар эсвэл өөрийн санаагаа сонгоно. Мөн видеоны урт, чанарыг (480p, 720p эсвэл 1080p) сонгоно. Албан ёсны загварын урт 5–20 секунд (зарим загвар үүнээс богино хүрээ зөвшөөрнө, нэг загвар 20 секундээр тогтсон, зарим загвар цөөн чанар санал болгоно), Өөрийн санаагаар бүтээсэн видео, түүний дотор Хадгалсан болон Хуваалцсан загвараас хийсэн видеоны урт 10–30 секунд. Видео хэвтээ (16:9) хэлбэртэй.
- Өөрийн санаагаар бүтээсэн видеонд Та санаагаа монгол эсвэл англи хэлээр бичнэ. AI түүнийг шалгаж, цагаар хуваасан зураг авалтын төлөвлөгөө (prompt) болгон сайжруулж болох бөгөөд Та түүнийг засаж болно; төлөвлөгөөг AI загварт зориулж англи хэл рүү орчуулна. AI мөн Таны зураг машин эсвэл үл хөдлөх хөрөнгийг харуулж буй эсэхийг тодорхойлно. Аль нь ч биш бол зураг машин эсвэл үл хөдлөх хөрөнгийг харуулах хүртэл Та үргэлжлүүлэх боломжгүй. Тодорхойлсон ангиллыг (машин эсвэл үл хөдлөх хөрөнгө) төлбөр төлөхөөс өмнө өөрчилж болно.
- Машины хувьд AI Таны зураг дээр улсын дугаар уншигдахаар харагдаж буй эсэхийг мөн шалгана. Харагдвал төлбөр төлөхөөс өмнө дугаарыг харуулах эсэхийг Танаас асууна. Та харуулахаар сонгоогүй бол дугаар хоосон харагдана. Харуулахаар сонговол AI дугаарыг яг таг хуулж чадахгүй байж болно. Бусад тээврийн хэрэгслийн дугаар үргэлж хоосон харагдана.
- Үл хөдлөх хөрөнгийн шинэ загварт Та зураг бүрийг нэрлэсэн нүдэнд (жишээ нь гадна тал, зочны өрөө, гал тогоо) байршуулна. AI зураг бүр аль өрөөг харуулж буйг таамаглах бөгөөд Та буруу шошгыг засна. Мөн нэмэлт мэдээлэл (унтлагын өрөө, угаалгын өрөө, нийлсэн гал тогоо ба зочны өрөө, тагт, харагдах байдал, давхар, барилгын нийт давхар, засварын байдал) оруулж болно. Эдгээр нь үл хөдлөх хөрөнгийн талбай, өрөөний тоотой хамт нэг англи өгүүлбэр болж AI загварт өгөх зааварт орох бөгөөд энэ өгүүлбэрт Таны утас, үнэ, байршил хэзээ ч орохгүй.
- Бид гадны AI загварын үйлчилгээ үзүүлэгчийн хиймэл оюун ухааны (AI) загвараар Таны зургаас видео бүтээж, дээр нь Таны мэдээллийг бичнэ: машинд үйлдвэрлэсэн, Монголд орж ирсэн он; үл хөдлөх хөрөнгөд байршил, талбай, өрөөний тоо; хоёуланд нь үнэ, холбоо барих утас. Таны сонгосон видеоны загвараас хамааран видеонд AI-ийн бүтээсэн дуу орж болно.
- Видео бэлэн болсны дараа Та түүнийг үзэх, татаж авах, зарын текстийг хуулж авах боломжтой.
- Захиалга илгээхийн өмнө Та видеон дээрх текстийг засварлагчаар засах, шинээр нэмэх, устгах боломжтой. Анхдагч текст нь Таны оруулсан мэдээллээс бэлтгэгдэнэ.
- Видео хадгалагдаж байх хугацаанд Та видеон дээрх текстийг засварлагчаар 20 хүртэл удаа үнэ төлбөргүй засаж болно. Засвар нь видеог AI-аар дахин бүтээхгүй, зөвхөн текстийг шинэчилнэ. Видеоны текстгүй анхны хувилбар устгагдсаны дараа текстийг засах боломжгүй.
- Бид видеог бэлэн болсноос хойш 30 хоног, премиум эрхтэй бол 90 хоног хадгалаад устгана. Хугацаа дуусахаас өмнө видеогоо татаж авна уу.
- Премиум нь төлбөртэй, хугацаатай эрх бөгөөд үнэ, хугацааг нь төлөхөөс өмнө харуулна. Премиум идэвхтэй үед видеог 90 хоног хадгална. Энэ нь хадгалагдаж байгаа болон бүтээгдэж буй видеод ч хамаарна.
- Та бэлэн болсон Өөрийн санаагаар бүтээсэн видеогоо Хадгалсан загвар болгон хадгалж болно (20 хүртэл). Загвараа нэрлэх, нэрийг нь солих, устгах боломжтой. Загварыг дахин ашиглавал түүний мэдээллээр бөглөгдсөн шинэ захиалга нээгдэнэ. Та бүх зүйлийг засаж болох бөгөөд шинэ захиалгын текстийг шалгаж, үнийг бусад Өөрийн санаагаар бүтээсэн видеоны адил тооцно.
- Бид Хадгалсан загварын жишээг хадгалснаас хойш 1 жил хүртэл хадгална; Та загвар эсвэл бүртгэлээ устгавал түүнээс өмнө устгана. Дараа нь загвар ажилласаар байх боловч видеоны оронд орлуулагч зураг харагдах бөгөөд Хуваалцсан загвар бусад худалдагчид харагдахаа болино.
- Видео зар нь тодорхой үр дүн (худалдан авагч, борлуулалт, мессеж, дуудлага) авчирна гэж бид амлахгүй.
5. Таны зураг, мэдээлэл
- Та оруулсан зургийнхаа эзэн, эсвэл түүнийг ашиглах эрхтэй байна.
- Та зураг, мэдээллээ зөвхөн Үйлчилгээ үзүүлэх зорилгоор ашиглах эрхийг бидэнд олгоно. Үүнд видео бүтээх, гадаад улс дахь AI үйлчилгээ үзүүлэгчээр боловсруулуулах, видеог Танд хүргэх, Таны хүсэлтээр Meta-д байршуулах, Таны хуваалцсан загварын хувьд 13-р хэсэгт заасан үйлдэл орно.
- Хүн (ялангуяа нүүр царай), бусдын машины улсын дугаар, бичиг баримт агуулсан зураг, бусдын зохиогчийн эрхтэй зураг оруулахгүй.
- Видео дээр нийтэд харагдах үнэ, холбоо барих утасны үнэн зөвийг Та хариуцна.
- Бид зургийг хадгалахаас өмнө түүний доторх байршил, камерын мэдээллийг устгадаг. Дэлгэрэнгүйг Нууцлалын бодлогоос үзнэ үү.
6. AI-аар бүтээсэн видео
- Видеог AI бүтээдэг тул Таны зургаас зарим нарийн зүйлээр (өнгө, хэлбэр, орчин, хөдөлгөөн) ялгаатай байж болно.
- Видеог татаж авах, хуваалцах, буст хийхээсээ өмнө шалгана уу. Бичвэрийн алдааг 4-р хэсэгт заасан засвараар засна. Бусад доголдлыг support@ad-creators.mn хаягаар мэдэгдэж, 10-р хэсэгт заасны дагуу шийдвэрлүүлнэ.
- Meta болон бусад платформ AI-аар бүтээсэн агуулгыг тэмдэглэгээгээр ялгаж болно.
- Бид видеотой холбоотой бидэнд хамаарах эрхийг (хэрэв байгаа бол) Танд шилжүүлнэ. Бид зөвхөн видеог хадгалах, Танд хүргэх, Таны хүсэлтээр Meta-д байршуулах эрх, мөн Таны хуваалцсан загварын хувьд 13-р хэсэгт Таны олгосон лицензийг үлдээнэ.
7. Таны зар, хууль
- Зар сурталчилгааны тухай хуулийн утгаар Та зар сурталчилгаа захиалагч, бид зар сурталчилгаа бүтээгч, буст хийсэн зарын хувьд Meta зар сурталчилгаа түгээгч байна. Та зарын агуулга (үнэ, байдал, он, байршил, утас) үнэн зөв, худалдан авагчийг төөрөгдүүлэхгүй байхыг хариуцна.
- Бид зарын агуулга үнэн болохыг нотлох баримтыг Танаас шаардах эрхтэй.
- Та хууль ёсоор худалдах, түрээслэх эрхтэй зүйлийнхээ зарыг л хийнэ. Хуулиар болон Meta-гийн Зар сурталчилгааны стандартаар хориглосон зүйлийн зар хийхгүй.
- Үл хөдлөх хөрөнгийн зар болон дуудлагын товчтой зарыг зөвхөн Монгол Улсад харуулна.
- Видеон дээр болон буст хийх зард бичсэн текстээ, мөн санаа, зураг авалтын төлөвлөгөөгөө Та өөрөө хариуцна.
- Та зараа сурталчлах аливаа текст, ердийн эможи бичиж болно. Харин дараах текстийг хүлээн авахгүй: хараал, доромжлол, дээрэлхэл, спам; хүн эсвэл бүлгийг дарамтлах, хувийн мэдээллийг нь задлах, сүрдүүлэх; бэлгийн, хүчирхийллийн, үзэн ядалтын эсвэл ялгаварлан гадуурхсан агуулга (түрээслэгч, худалдан авагчийг ялгаварласан агуулга орно); улс төр, шашны сурталчилгаа; луйврын шинжтэй текст (урьдчилгаа шаардах, хуурамч баталгаа, бусдын мэдээлэл); зартай холбоогүй үйлчилгээний холбоос, холбоо барих хаяг; зохисгүй эможи.
- Бид текст бүрийг AI-аар автоматаар шалгана. Шалгалтад тэнцээгүй эсвэл шалгаж чадаагүй текстийг видеонд оруулахгүй, төлбөр авахгүй, Meta-д илгээхгүй; Та түүнийг засах эсвэл устгана. Үнэ, он, талбай зарын мэдээлэлтэй таарахгүй бол бид анхааруулах боловч саатуулахгүй. Таны санаа, зураг авалтын төлөвлөгөөнд ижил шалгалт хамаарна: шалгалтад тэнцээгүй эсвэл шалгаж чадаагүй санаа, төлөвлөгөөг видеонд ашиглахгүй.
- Шалгалтын татгалзлыг хүчингүй болгох боломжгүй: манай ажилтан ч татгалзсан текстийг нийтэлж чадахгүй, зөвхөн харах боломжтой.
8. Facebook, Instagram-д буст хийх
- Буст хийхэд Таны өөрийн Facebook хуудас, төлбөрийн хэрэгсэлтэй зарын бүртгэл хэрэгтэй бөгөөд Та Facebook-ийн цонхоор зөвшөөрөл олгоно. Зөвшөөрөл тус бүрийн зорилгыг Нууцлалын бодлогын 4.3-т заасан.
- Таны зааврын дагуу, Таны өмнөөс бид дараах үйлдлийг хийнэ: кампанит ажил, зарын багц, зарын бүтээл, зарыг идэвхгүй төлөвт үүсгэх; видеог Таны зарын бүртгэлд байршуулах; Таныг баталгаажуулсны дараа зарыг идэвхжүүлэх; Таны хүсэлтээр түр зогсоох, үргэлжлүүлэх, зогсоох, төсөв, дуусах огноог өөрчлөх; үр дүнг унших. Буст бүр Таны баталгаажуулалтаар л эхэлнэ.
- Хуудсанд тань Instagram бүртгэл холбоогүй бол бид зарыг Instagram-д харуулахын тулд Meta-гийн хуудсанд суурилсан Instagram бүртгэлийг ашиглана. Бид Таны хуудсан дээр юу ч нийтлэхгүй.
- Зарын зорилго нь мессеж эсвэл дуудлага байна.
- Зар бүр Таны өөрийн зарын бүртгэлд үүснэ. Бид Таны зарыг өөр зар сурталчлагчийн зартай нэг зарын бүртгэлд нэгтгэхгүй.
- Зарын төлбөрийг Meta Таны зарын бүртгэлээс шууд авна. Бид буст хийхэд шимтгэл авахгүй. Хүсвэл бид зарцуулсан мөнгө, кампанит ажлын тохиргоог Танд гаргаж өгнө. Эдгээрийг AdCreator дотор мөн харуулдаг.
- Зарыг хянах, харуулах, төлбөр авах, зар болон бүртгэлийг хязгаарлах шийдвэрийг Meta гаргана.
- Та холболтоо салгах, Facebook-ээс AdCreator-ыг хасах, эсвэл мэдээллээ устгуулахад бидний хандалт дуусна. Харин явж буй зар Таны зарын бүртгэлд үргэлжилж, Meta төлбөр авсаар байна. Түүнийг Ads Manager-ээс зогсооно уу.
- Буст хийснээр Та Meta-гийн Үйлчилгээний нөхцөл, Арилжааны нөхцөл, Өөрөө үйлчлэх зарын нөхцөл, Зар сурталчилгааны стандарт, Олон нийтийн стандартыг хүлээн зөвшөөрч, мөрдөнө.
- Та Үйлчилгээгээр дамжуулан авсан Meta-гийн мэдээллийг Meta-гийн нөхцөл, бодлогыг зөрчин ашиглахгүй.
9. Үнэ, төлбөр
- Видеоны үнэ түүний урт, чанараас хамаарах бөгөөд захиалахаас өмнө төгрөгөөр харагдана. Өөрийн санаагаар бүтээсэн видео, мөн Хадгалсан болон Хуваалцсан загвараар хийх захиалгад өөрийн үнэ үйлчилнэ; үүнийг мөн адил харуулна. Захиалгыг илгээх үед үнэ тогтож, дараа нь өөрчлөгдөхгүй.
- Та төлбөрийг QPay-ээр, QR код уншуулах эсвэл банкны аппаар төлнө. Төлбөр баталгаажмагц бид видео бүтээж эхэлнэ.
- Төлөгдөөгүй захиалга 7 хоногийн дараа хүчингүй болж, нэхэмжлэх нь цуцлагдана.
- Премиумын үнэ, хугацааг төлөхөөс өмнө харуулна.
- Үнэгүй видеогоор хийх захиалгын үнэ 0 төгрөг бөгөөд түүнд QPay-ээр төлбөр төлөхгүй (15-р хэсэг).
10. Цуцлах, бүтээлт амжилтгүй болох, буцаан олгох
10.1 Захиалга цуцлах
Та ноорог болон төлөгдөөгүй захиалгыг хэдийд ч төлбөргүйгээр цуцалж болно. Төлбөр баталгаажмагц бид видео бүтээж эхэлдэг тул төлсөн захиалгыг AdCreator дотроос цуцлах боломжгүй.
10.2 Цуцлагдсан захиалгад орсон төлбөр
Захиалга цуцлагдсан эсвэл хүчингүй болсны дараа төлбөр орж ирвэл бид видео бүтээхгүй бөгөөд төлбөрийг бүрэн буцаан олгоно.
10.3 Бүтээлт амжилтгүй болох
Видео бүтээх явцад алдаа гарвал бид үнэ төлбөргүй дахин оролдоно. Видеог бүтээж чадахгүй бол алдаа гарснаас хойш 3 хоногийн дотор төлсөн үнийг бүрэн буцаан олгоно.
10.4 Доголдол
Доголдол гэж видео дээрх бичвэр Таны оруулсан мэдээллээс зөрөх; видеоны загвар, урт, чанар захиалгаас зөрөх; видео тоглохгүй эсвэл дутуу байх; видео Таны зураг дээрх машин, үл хөдлөх хөрөнгөөс илт өөр зүйлийг харуулахыг хэлнэ. Видео доголдолтой бол бид түүнийг үнэ төлбөргүй засах эсвэл дахин бүтээнэ. Боломжгүй бол үнийг бүрэн, эсвэл доголдолд тохирох хэсгийг буцаан олгоно.
10.5 Сэтгэлд нийцээгүй видео
Захиалгад нийцсэн, доголдолгүй видеог загвар, хөдөлгөөн, өнгө зэрэг AI-ийн уран сайхны шийдэл Таны сэтгэлд нийцээгүй гэсэн шалтгаанаар буцаан олгохгүй.
10.6 Шаардлага гаргах хугацаа
Доголдлын талаарх шаардлагаа видео бэлэн болсноос хойш 6 сарын дотор support@ad-creators.mn хаягаар гаргана уу. Захиалгын дугаар, доголдлын тайлбарыг бичнэ үү.
10.7 Буцаан олгох журам
Бид буцаан олгохоор шийдвэрлэснээс хойш 7 ажлын өдрийн дотор (10.3-т заасан тохиолдолд алдаа гарснаас хойш 3 хоногийн дотор) мөнгийг Таны төлбөр төлсөн эх сувгаар, QPay-ээр эсвэл банкны шилжүүлгээр буцаан олгоно. Шаардлагатай бол төлбөр төлсөн дансны мэдээллийг Танаас асууна. Буцаан олгосон дүн захиалгын хуудсанд харагдана.
10.8 Зарын төлбөр
Буст хийсэн зарын төлбөрийг Meta Таны зарын бүртгэлээс авдаг тул бид түүнийг буцаан олгохгүй. Энэ талаар Meta-д хандана уу.
10.9 Хуулиар олгосон эрх
Энэ хэсэг Хэрэглэгчийн эрхийг хамгаалах тухай хууль, Иргэний хуулиар Танд олгосон эрхийг хязгаарлахгүй.
11. Хориглох үйлдэл
Та дараах үйлдлийг хийхгүй:
- хууль бус, худал, төөрөгдүүлсэн зар хийх;
- бусдын хувийн мэдээлэл, зохиогчийн эрх, бусад эрхийг зөрчих;
- Үйлчилгээг автомат хэрэгслээр ашиглах, түүнээс мэдээллийг автоматаар цуглуулах (scraping);
- Үйлчилгээний хэвийн ажиллагааг тасалдуулах, аюулгүй байдлын хамгаалалтыг тойрох оролдлого хийх;
- бүртгэлээ бусдад ашиглуулах, бусдын бүртгэлээр нэвтрэх;
- Meta-гийн Олон нийтийн стандарт, Зар сурталчилгааны стандартыг зөрчих.
12. Хувийн мэдээлэл
Бид Таны мэдээллийг Нууцлалын бодлогын дагуу боловсруулна. Мэдээллээ хэрхэн устгуулахыг Мэдээлэл устгуулах заавраас үзнэ үү.
13. Бидний өмч, Таны загвар
- Үйлчилгээний программ хангамж, Албан ёсны загварууд, AdCreator нэр, дизайн бидний өмч хэвээр байна. Тэдгээрийг бидний зөвшөөрөлгүйгээр хуулбарлах, өөрчлөх, бусдад худалдахыг хориглоно. Энэ нь Танд шилжүүлсэн видеог ашиглах Таны эрхийг хязгаарлахгүй.
- Таны Хадгалсан загвар болон түүний жишээ Таных хэвээр байна. Нөхцөл нь бидэнд тэдгээрийн өмчлөлийг олгохгүй.
- Та Хадгалсан загвараа хуваалцахдаа тусдаа зөвшөөрлийн нүдийг тэмдэглэнэ. Ингэснээр Та бидэнд төлбөргүй, онцгой бус лиценз олгоно: уг загварын жишээ, гарчиг, тайлбарыг бусад худалдагчид харуулах, мөн тэдэнд загварын зураг авалтын төлөвлөгөө, урт, чанар, өөрсдийнх нь зарын мэдээллээр бөглөгддөг текстүүдийн (зарын мэдээлэл, үнэ) зохион байгуулалтыг өөрсдийн захиалгад дахин ашиглуулах. Энэ лиценз нь Та загвараа хуваалцахаа зогсоох, загвараа эсвэл бүртгэлээ устгах хүртэл, эсвэл жишээний хугацаа дуустал үйлчилнэ. 16. Хариуцлага

These Terms of Service (the "Terms") set out your and our rights and obligations when you use AdCreator. Please read the Terms in full before you use the Service.
1. The parties and accepting the Terms
AdCreator (ad-creators.mn, the "Service") is provided by Lumo Promo LLC (Лумо промо ХХК) ("we"). The company's address and registration number are at the end of this page.
The Terms are a contract between us and you, the person using the Service, and are standard contract terms within the meaning of the Civil Code.
Before you sign in, you confirm that you are 18 or older and accept the Terms by ticking, yourself, a box that is not ticked in advance. We record your Facebook-authenticated account, the version you accepted and the date. The Terms are always at ad-creators.mn/terms and are linked at the bottom of AdCreator's pages.
The Terms are published in Mongolian and English. If the two versions differ, the Mongolian text prevails.
2. Definitions
The following terms used in the Terms have the meanings below:
- "Service" means the ad-creators.mn website and the AdCreator app on it;
- "Order" means your request to have a video ad made;
- "Video ad" means a video that artificial intelligence (AI) makes from your photos, with the details you entered added as text;
- "Boost" means running a Video ad as a paid ad on Facebook and Instagram through your own Facebook Page and ad account;
- "Meta" means Meta Platforms, the company that runs Facebook and Instagram;
- "Premium" means a paid right to have your videos kept longer for a period of time;
- "Own-idea video" means a Video ad that the AI makes from an idea you write yourself, instead of from one of our video templates;
- "Clean video" means a video without the texts written on it;
- "Saved template" means an Own-idea video that you keep to use again. It keeps the idea you wrote, the prompt (the shot list the AI made the video from), the length, the quality, the text layout (the place, size, colour, font, timing and effects of the texts) and a copy of the Clean video, which is called its "example";
- "Shared template" means a Saved template that you asked to show to other sellers and that we approved;
- "Official template" means a video template that we make and offer to all sellers, including one we make from a Shared template;
- "Free video" means a right to have one video made free of charge, given for inviting a friend as section 15 describes.
3. Who may use the Service
- Only people aged 18 or over with full legal capacity may use the Service.
- You sign in with your own Facebook account and enter your Mongolian phone number.
- You give true information and do not let others use your account.
- If you use the Service for business, such as selling cars or property or acting as an agent, the Terms apply equally to you and your business.
4. The Service
- You upload photos of a car or a property (from 3 to 30, depending on the video's length) and choose a template or your own idea. You also choose the video's length and its quality (480p, 720p or 1080p). An Official template is 5 to 20 seconds (some allow a narrower range, one is fixed at 20 seconds, and some offer fewer qualities); an Own-idea video, including one made from a Saved or Shared template, is 10 to 30 seconds. The video is landscape (16:9).
- For an Own-idea video, you write your idea in Mongolian or English. AI checks it, and can improve it into a prompt, a timed shot list that you can edit; the prompt is translated into English for the AI model. AI also looks at your photos to find out whether they show a car or a property. If they show neither, you cannot continue until they do. You can change the detected category (car or property) before you pay.
- For a car, AI also looks at your photos for a readable licence plate. If it finds one, we ask you before payment whether to show it. The plate is shown blank unless you choose to show it. If you choose to show it, AI may not copy it exactly. Plates on other vehicles are always shown blank.
- On the new property templates, you place each photo in a labelled slot (such as the exterior, living room or kitchen). AI guesses each photo's room, and you correct any wrong label. You may add optional property facts (bedrooms, bathrooms, open plan, balcony, view, floor, total floors and condition). Together with the property's area and number of rooms, they go, in English, as one sentence into the AI model's instruction, which never includes your phone number, price or location.
- We make a video from your photos with an artificial intelligence (AI) model of an external AI service provider and write your details on it: for a car, the years it was built and imported into Mongolia; for a property, its location, area and number of rooms; for both, the price and the contact phone. Depending on the video template you chose, the video may include sound made by the AI.
- Once the video is ready, you can watch it, download it and copy the ad text.
- Before you send your order, you can change, add and delete the texts on the video in the editor. The texts it starts with are made from the details you entered.
- While the video is kept, you can fix the texts on it in the editor up to 20 times free of charge. A fix does not make the video again with AI; it only updates the texts. Once the raw video it was made from (without texts) has been deleted, its texts can no longer be fixed.
- We delete the video 30 days after it is ready, or 90 days with premium. Download your video before then.
- Premium is a paid right for a set period; we show its price and period before you pay. While premium is active, videos are kept 90 days. This also applies to videos already kept or being made.
- You can save a ready Own-idea video as a Saved template, up to 20 templates. You can rename and delete your templates. Reusing a template opens a new order filled in with its details. You can change everything, and the new order's texts are checked and its price is worked out like any other Own-idea video's.
- We keep a Saved template's example for up to 1 year from saving, or less if you delete the template or your account. After that the template still works, but shows a placeholder instead of the video, and a Shared template is no longer shown to other sellers.
- We do not promise that a Video ad will bring any particular result (buyers, sales, messages or calls).
5. Your photos and details
- You own the photos you upload or have the right to use them.
- You allow us to use your photos and details only to provide the Service. This includes making the video, having it processed by an AI provider abroad, delivering the video to you, uploading it to Meta at your request and, for a template you share, what section 13 describes.
- You do not upload photos showing people (faces in particular), other people's car plates or documents, or images whose copyright belongs to others.
- You are responsible for the accuracy of the price and contact phone that will be public on the video.
- Before storing a photo, we remove the location and camera data in it. See the Privacy Policy for details.
6. The AI-made video
- The video is made by AI, so it may differ from your photos in some details (colour, shape, surroundings, movement).
- Check the video before you download, share or boost it. Fix text errors with the fixes in section 4. Report other defects to support@ad-creators.mn to have them dealt with as section 10 describes.
- Meta and other platforms may mark AI-made content with a label.
- We transfer to you whatever rights we hold in the video, if any. We keep only the right to store the video, deliver it to you and, at your request, upload it to Meta, and, for a template you share, the licence you give us in section 13.
7. Your ad and the law
- Under the Law on Advertising, you are the advertiser, we are the advertisement creator, and for boosted ads Meta is the advertisement distributor. You are responsible for the ad's content (price, condition, years, location, phone) being true and not misleading buyers.
- We have the right to ask you for proof that the ad's content is true.
- You advertise only items you may lawfully sell or rent. You do not advertise anything prohibited by law or by Meta's Advertising Standards.
- Property ads and ads with a call button are shown only in Mongolia.
- You are responsible for the texts you write on the video and in a boosted ad, and for your idea and prompt.
- You may write any text that promotes your ad, and normal emojis. We do not accept: profanity, insults, trolling or spam; harassing a person or group, exposing their personal data or intimidating them; sexual, violent, hateful or discriminatory content (including content that discriminates against tenants or buyers); political or religious campaigning; texts that show signs of a scam (asking for a deposit first, false guarantees, other people's data); links or contacts for unrelated services; inappropriate emojis.
- We check every text automatically with AI. A text that fails the check, or that could not be checked, is not put on the video, paid for or sent to Meta; you change it or delete it. When a price, year or area differs from the ad's details we warn you, but do not stop you. The same check applies to your idea and your prompt: one that fails it, or could not be checked, is not used for a video.
- A refusal by the check cannot be overridden: even our staff cannot publish a refused text, only see it.
8. Boosting on Facebook and Instagram
- To boost, you need your own Facebook Page and an ad account with a payment method, and you grant permissions in Facebook's window. What each permission is for is stated in section 4.3 of the Privacy Policy.
- On your instructions and on your behalf, we do the following: create the campaign, ad set, ad creative and ad, switched off; upload the video to your ad account; switch the ad on after you confirm; pause, resume or stop it and change its budget or end date when you ask; and read its results. Each boost starts only with your confirmation.
- If your Page has no linked Instagram account, we use Meta's Page-backed Instagram account to show the ad on Instagram. We never post anything on your Page.
- The ad's goal is messages or calls.
- Each ad is created in your own ad account. We never combine your ads with another advertiser's ads in one ad account.
- Meta bills the ad spend directly to your ad account. We charge no fee for boosting. On request, we give you the amount spent and the campaign's settings. AdCreator also shows them.
- Decisions to review, show and bill ads, and to restrict ads and accounts, are made by Meta.
- When you disconnect, remove AdCreator from Facebook or have your data deleted, our access ends. Ads already running, however, continue in your ad account and Meta keeps billing you. Stop them in Ads Manager.
- By boosting, you accept and will follow Meta's Terms of Service, Commercial Terms, Self-Serve Ad Terms, Advertising Standards and Community Standards.
- You do not use Meta data obtained through the Service in breach of Meta's terms and policies.
9. Prices and payment
- A video's price depends on its length and quality and is shown in tögrög before you order. Own-idea videos, and orders from a Saved or Shared template, have their own prices, shown the same way. The price is fixed when you submit the order and does not change afterwards.
- You pay through QPay, by scanning the QR code or in your bank's app. We start making the video as soon as the payment is confirmed.
- An unpaid order lapses after 7 days, and its invoice is cancelled.
- We show premium's price and period before you pay.
- An order made with a Free video costs ₮0, and nothing is paid for it through QPay (section 15).
10. Cancellations, failed videos and refunds
10.1 Cancelling an order
You may cancel a draft or an unpaid order at any time at no cost. We start making the video as soon as payment is confirmed, so a paid order cannot be cancelled in AdCreator.
10.2 Payment for a cancelled order
If a payment arrives after the order was cancelled or lapsed, we do not make the video, and we refund the payment in full.
10.3 When making the video fails
If making the video fails, we try again free of charge. If we cannot make the video, we refund the full price within 3 days of the failure.
10.4 Defects
A defect means that the text on the video differs from the details you entered; that the video's template, length or quality differs from the order; that the video does not play or is incomplete; or that the video shows something clearly different from the car or property in your photos. If the video has a defect, we fix it or make it again free of charge. If we cannot, we refund the price in full, or the part that matches the defect.
10.5 A video you don't like
We do not refund a video that matches the order and has no defect because the AI's creative choices, such as the style, movement or colours, are not to your taste.
10.6 When to claim
Make your claim about a defect to support@ad-creators.mn within 6 months of the video being ready. Include the order number and a description of the defect.
10.7 How refunds are made
We make a refund within 7 working days of deciding to refund (in the case of section 10.3, within 3 days of the failure), to the original payment channel, through QPay or by bank transfer. If needed, we will ask you for the details of the account you paid from. The refunded amount is shown on the order page.
10.8 Ad spend
Meta bills the spend on boosted ads to your ad account, so we do not refund it. Contact Meta about it.
10.9 Your rights under the law
This section does not limit the rights the Consumer Protection Law and the Civil Code give you.
11. What you must not do
You must not:
- create unlawful, false or misleading ads;
- breach other people's personal data, copyright or other rights;
- use the Service with automated tools, or collect data from it automatically (scraping);
- try to disrupt the Service's normal operation or get around its security;
- let others use your account, or sign in with someone else's account;
- breach Meta's Community Standards or Advertising Standards.
12. Personal data
We process your data under the Privacy Policy. For how to have your data deleted, see User Data Deletion.
13. Our property, and your templates
- The Service's software, our Official templates, the AdCreator name and its design remain our property. You may not copy, change or sell them to others without our permission. This does not limit your right to use the video transferred to you.
- Your Saved templates and their examples stay yours. These Terms give us no ownership of them.
- When you share a Saved template, you tick a separate consent box. You then give us a free, non-exclusive licence to show its example, title and description to other sellers, and to let them reuse its prompt, length, quality and the layout of the texts that their own listing fills in (its details and its price) in their own orders. This licence lasts until you unshare the template, delete it or delete your account, or until its example expires. Share a template only if you have the right to share its video, as section 5 requires for your photos.
- A seller who reuses your Shared template gets its prompt. If you did not have AI improve your idea, the prompt is your idea as you wrote it. They never get the texts you wrote on the video yourself.
- Our staff review a template before it is shown, and its prompt is checked by AI as section 7 describes for texts. The rules of section 7 apply to it, and a refusal by the check cannot be overridden: a refused prompt cannot be shared. We may refuse to show a template, and may remove a Shared template at any time, for example when it breaks these Terms or someone's rights. When we refuse one, we tell you the reason in AdCreator.
- You can unshare a template at any time. We then stop showing it, and its video is removed from public view. Orders already made from it are not affected.
- We may turn a Shared template into an Official template. By sharing, you also give us a free, permanent, irrevocable, non-exclusive licence to use the example, title, description and prompt in an Official template made while the template was shared; unsharing, deleting your template or deleting your account does not end it. The Official template is our own copy, independent of your Saved template, and stays in the Service if you unshare or delete your template or your account. It shows no name or contact.
14. Third-party services
The Service uses the services of third parties such as Meta (sign-in, boosts), QPay and banks (payment), an external AI service provider (the AI model), another external AI service provider (translation, and checks of texts, ideas and photos) and Amazon Web Services (servers). Their own terms apply to them. The texts on the video are drawn with emojis and fonts under third parties' open licences. Emoji: Twemoji © Twitter, Inc and other contributors, CC-BY 4.0 (https://creativecommons.org/licenses/by/4.0/). Fonts: SIL Open Font License / Apache 2.0. The Service may be delayed when their services fail or because of decisions they make. This does not reduce our responsibility for the video you ordered.
15. Inviting friends
- On the "Invite friends" page in AdCreator, you get your own invite link and code to send to your friends. There is no limit on how many friends you invite.
- Only a new user signing up can use an invite code, when they enter their phone number for the first time. A friend who arrives through your link has the code filled in automatically. No one can use their own code.
- When a friend who signed up with your code has a paid video ready for the first time, we give you one Free video of exactly that video's length and quality. Only that first video counts, and we give no Free video for your friend's later videos. The friend you invite gets no reward.
- Use a Free video within 30 days of your friend's video becoming ready. A Free video not used within that time lapses.
- You can use a Free video for any video that allows its length and quality: one made from an Official template, from a Saved or Shared template, or an Own-idea video. An order made with a Free video costs ₮0, and its length and quality cannot be changed.
- A Free video has no cash value and cannot be exchanged for money, transferred to others or sold.
- We may pause or end the invitation programme at any time. While it is paused or ended, codes are not accepted and no Free videos are given; if your friend's first paid video becomes ready in that time, no Free video is given for it, then or later. Free videos already given can still be used until they expire.
- We may cancel a Free video obtained by abuse, such as through fake accounts or by inviting yourself beyond normal use.
- If we cannot make the video of an order made with a Free video (section 10.3), we may give the Free video back to you. A Free video given back can be used for at least 7 days from that day.
16. Liability
- We are obliged to provide the Service as the Terms describe.
- We are not liable for your ads' results (sales, messages, calls), for Meta's decisions about your ads or account, or for loss caused by force majeure beyond our control.
- To the extent the law allows, our liability in connection with an order is limited to the amount you paid for that order.
- This section does not release us from liability for intent or gross negligence, and does not limit your rights under the law, such as claiming damages or having defects remedied.
17. Suspension and closing your account
- We may suspend or end your right to use the Service if you seriously or repeatedly breach the Terms, use the Service unlawfully, or if the law or a competent authority requires it. Except for serious breaches, we will tell you beforehand and explain why.
- You may close your account at any time with "Delete my account" in Profile. What happens to your data is described in User Data Deletion.
18. Changes to the Terms
- If we change the Terms in a way that needs your agreement, we will update the version and ask for your agreement again in AdCreator. The new Terms apply to you only after you agree to them.
- We describe each change and its reason in the version history below.
- If you don't agree, you may stop using the Service and have your account deleted.
- A change never worsens your rights for orders already paid.
Version history:
- Version 1.0 (7 October 2026): first version.
- Version 1.1 (12 October 2026): videos are kept 30 days, or 90 days with premium, instead of 7 and 30 (section 4).
- Version 1.2 (13 October 2026): the texts on the video are edited in the editor, and a ready video's texts can be fixed free up to 20 times (section 4); you are responsible for your texts, the acceptable-text rules, the AI check, and that its refusals cannot be overridden (section 7); the emoji and font licences (section 14).
- Version 1.3 (14 October 2026): Own-idea videos of 10 to 30 seconds (templates 5 to 20 seconds, photos from 3 to 30), with their own prices, the AI check of your idea and prompt, the AI improving and translating them, and the AI looking at photos for a car or a property and for a licence plate (sections 4, 7, 9 and 14); the new property templates, with labelled photos and optional facts (section 4); you can save an Own-idea video as a template, and its example is kept up to 1 year (section 4); you can share a template with other sellers, the licence you give when you do, our review and removal of Shared templates, making one an Official template under a lasting licence, and that only Official templates are our property (sections 5, 6 and 13); the new terms (section 2).
- Version 1.4 (14 October 2026): inviting friends: when the first paid video of a friend who signed up with your code becomes ready, a Free video of the same length and quality, to be used within 30 days, which cannot be exchanged for money, transferred or sold; pausing or ending the invitation programme; cancelling Free videos obtained by abuse; giving back a Free video spent on a video we could not make (sections 2, 9 and 15); the former sections 15 to 19 are now 16 to 20.
19. Complaints and disputes
- Send complaints and suggestions to support@ad-creators.mn. We answer within 30 days.
- Disputes are first resolved by negotiation. If we cannot agree, you may go to the state body responsible for consumer protection or to the courts of Mongolia. The National Human Rights Commission of Mongolia (www.nhrcm.gov.mn, 7000-0222) receives complaints about personal data.
- The laws of Mongolia govern the Terms.
